In some cases, prisoners cannot benefit from the provisions of conditional release. The following are the cases where conditional release provisions cannot be applied:
-In case of application of the provisions of repetition for the second time, the convict is not conditionally released (5275 m.108/3),
– According to the Law No. 4771, convicts whose death sentence is converted to a prison sentence cannot benefit from the provisions of parole.
-5237 numbered of the Turkish Penal Code Book Two, chapter four, “crimes against the security of the state” is the fourth Episode entitled, “crimes against the constitutional order and the functioning of this order entitled” the fifth chapter, “the National Defense” crimes against the activities of an organization entitled under Chapter Six of one of the crimes within the framework of processing, hence “to aggravated life imprisonment conviction, the case is” conditional release provisions (5275 m.107/16).
