Guardianship, limitation and trusteeship

ARTICLE 10 – (1) The reasons for granting or terminating a guardianship or restriction decision are subject to the national law of the person about whom the guardianship or restriction decision is requested to be granted or terminated.

(2) In cases where it is not possible to issue a guardianship or restriction decision in accordance with the national law of a foreigner, a guardianship or restriction decision may be made or lifted in accordance with Turkish law if the habitual residence of this person is in Turkey. Turkish law is also applied in cases where the person is necessarily located in Turkey.

(3) All matters related to restriction or guardianship and trusteeship other than the reasons for granting or terminating a guardianship or restriction decision are subject to Turkish law.
